To use the vernacular of one of our most popular presidents "here they go again". I am of course referring to "Patriot Act II". Or the second attempt by this administration to destroy any remaining value of our (what once was) Constitutional Republic. I do wish that someoneÑanyone would explain to those moron neo-cons of the Bush administration that our enemies are not domestic but foreign. Every provision that I read of Patriot Act seems directed at American citizens; I find this ludicrous in view of the fact that foreigners accomplished all the terrorist acts we know of. Seems we are not the only people of this mindset. U.S. District Judge Victor Marrero of the NY Federal Court ruled in a case involving an Internet service company that the present Patriot act is in violation of the Constitution as well as the Bill of Rights. No news there, this author has been saying exactly that since the day he read the law. Which by the way was weeks after it passed in our federal legislature, and before any of the fools we elected to represent us read it. It was like the NAFTA accord not published until long after congress voted for it. Let us hope that this time around our electors will have sufficient stamina to at least have their staff lawyers read it before they vote on it. There are some very pertinent issues in this new act. We are well aware of the fact that the U.S. Justice department has requested hundreds of secret so called John Doe warrants so many in fact this year that they outnumber those issued in the previous ten years. We are also aware of secret courts, where accused are not given the benefit of council, not directly charged, and in some cases incarcerated for years without charge, their Habeas Corpus rights having been suspended in violation of the Constitution. The new act a true piece of fascist or communist, (hey what's the difference they're both socialists), legislation expands the power of federal law enforcement to a level even surpassing the power of the Nazi Gestapo. Well, what the hell, our federal and local police parade around in black costumes bearing ski masks, something even the Gestapo did not do. Let us review some of the powers to be given the FBI, BATF, Secret Service, and for all we know the federal park rangers in this onerous new proposal. Search anyone at any time without probable cause, view every E-mail sent, obtain telephone copy records without warrant, obtain insurance and bank records without warrants, jail any bank insurance telephone employee who tells you that your account has been pilfered by a federal agency, incarcerate people without warrant, have secret trials, no requirement for a phone call by the arrested, obtain library record of individuals, pilfer credit card purchases without notification, issue national security letters, a type of search warrant that is secret, and suspend Habeas Corpus. These initiatives violate the Constitution and Amendments I, IV, V, VI, VII, VIII, IX, of the Bill of Rights and Amendment VX, XXVI, of the Constitution. According to my sources Sen. Jon Kyl (R. AZ), apparently a true Constitutional scholar, has recommended expanding the afore listed provisions of the Patriot Act to expand the death penalty, increasing subpoena power of the Department of Justice, and to allow judges to deny bail. Why Senator Kyl does not simply offer a law to suspend the entire Constitution and Bill of Rights is an issue we ponder. As Benjamin Franklin so aptly put it upon being asked at the close of the Constitutional convention: "Sir what have you brought forth?" He responded, "A Constitutional Republic if you can keep it sir!" Frankly we are doing a lousy job of that! It has become evident in the last 12 months that the exercise being carried out by our legislative and executive departments has little to do with fighting terrorism, and a great deal to do with the establishment of an empire. Consider all the actions taken by them since 9-11. Not one of them is in any way related to any serious attempts to stem or eliminate terrorism. If in fact the plan were to protect America and Americans the very first step would be the securing of our borders. Second would be the expulsion as ordered by the Justice Department of over 380,000 convicted felon illegal immigrants. The third would be the deportation of all remaining illegal immigrants. The fourth would be the elimination of entry visas to citizens of so labeled "terrorist friendly" states. Over 40,0000 such visas have been issued since 9-11. No one inside government has even brought these issues to the forefront. Just exactly like the war on drugs, the war on poverty, the war on gambling, and prohibition, all are a farce perpetrated on the American public.
